The offer and sale of products on civico41.com are governed by these Conditions of Sale, together with the Return Policy and the Privacy Policy.

The products purchased on civico41.com are sold directly by Civico 41 di Andrea Bovani ("the Seller"), with registered office in Italy, Via Curtatone e Montanara, 35/41, 51100, Pistoia.

1. Our trade policy

1.1 The Seller offers the products for sale on civico41.com and carries out its e-commerce activity exclusively towards its end users who are "consumers".

1.2 When we speak of "consumer" we refer to any natural person who acts on civico41.com for purposes not related to his commercial, entrepreneurial or professional activity, possibly carried out. If you are not a "consumer", we invite you to refrain from concluding commercial transactions on civico41.com.

1.3 In consideration of its commercial policy, the Seller reserves the right not to process orders from subjects other than the "consumer" or in any case to orders that do not comply with its commercial policy.

1.4 These Conditions of Sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on civico41.com between users of civico41.com and the Seller.

1.5 The Conditions of Sale do not, however, regulate the supply of services or the sale of products by subjects other than the Seller who are present on civico41.com via links, banners or other hypertext links. Before submitting orders and purchasing products and services from parties other than the Seller, we advise you to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce between civico41.com users and third parties.

2. Conditions of use of the gift card
2.1 You cannot use a Gift Card to purchase a Gift Card online.

2.2 If the credit on your Gift Card(s) cannot cover the total payable, you will need to use a valid credit card to complete the payment. If the credit on your Gift Card(s) is higher than the total payable, the remaining credit will remain on your Gift Card and you can use it on your next purchase. For any question or information, contact our Customer Service.

2.3 The Gift Card can be used online, is not transferable and cannot be refunded in any way, not even in cash.

2.4 We cannot replace lost or stolen Gift Cards.

2.5 Sales taxes are not included in the Gift Card, but are applied at the time of use for the purchase.

3. How to conclude the contract with the seller
3.1 To conclude the purchase contract for one or more products on civico41.com, you will have to fill in the order form in electronic format and send it to the Seller electronically, following the relative instructions.

3.2 The order form contains a reference to the Conditions of Sale and the Return Policy, and a summary of the information on the essential characteristics of each product ordered and the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product and the methods of delivery of the products purchased, the shipping and delivery costs, the conditions for exercising your right of withdrawal and the methods and times for returning the products purchased.

3.3 The contract is concluded when the Seller receives your order form electronically, after verifying the correctness of the data relating to your order.

3.4 Before proceeding with the purchase of the products, by sending the order form, you will be asked to carefully read the Conditions of Sale and the Return Policy, to print a copy using the print command and to memorize or reproduce one copy for your personal use.

3.5 The order form will be filed in our database for the period of time necessary to process the orders and in any case in accordance with the law.

3.6 Once the contract is concluded, the Seller will take charge of your purchase order.

3.7 The Seller may not process your purchase orders which do not give sufficient guarantees of solvency or which are incomplete or incorrect or in the event of unavailability of the products. In these cases, we will inform you by e-mail that the contract has not been concluded and that the Seller has not processed your purchase order, specifying the reasons. If the products, presented on civico41.com, are no longer available or on sale at the time of your last access to the site or the sending of the order form, it will be the Seller's responsibility to notify you promptly and in any case within thirty (30 ) days starting from the day following the one in which you will have sent your order to the Seller, the possible unavailability of the products ordered. In case of forwarding the order form and payment of the price, the Seller will refund the amount already paid by you.

3.8 By submitting the order form electronically, you unconditionally accept and undertake to observe these Conditions of Sale in relations with the Seller. If you do not agree with some of the terms contained in the Conditions of Sale, we invite you not to submit the order form for the purchase of products on civico41.com.

3.9 By submitting the order form, you confirm that you know and accept the Terms of Sale and the additional information contained in civico41.com, also referred to via links, including the Terms of Use and the Privacy Policy of civico41.com.

3.10 Once the contract is concluded, the Seller will send you, by e-mail, a receipt of the purchase order, containing the information already contained in the order form (reference to the Conditions of Sale and Return Policy, information relating to the essential characteristics of the product and a detailed indication of the price, means of payment, your right of withdrawal and delivery costs).

4. Guarantees and indication of product prices
4.1 On civico41.com, only products marked with the "Civico41 di Andrea Bovani" brand are offered for sale and purchased directly from the Seller from Civico41 srl ("the Seller"), with registered office in Italy, Via Curtatone e Montanara, 35/41, 51100, Pistoia .

4.2 The Seller does not sell used, irregular or inferior products to the corresponding standards offered on the market.

4.3 The essential characteristics of the products are presented on civico41.com within each product sheet. However, the images and colors of the products offered for sale on civico41.com may not correspond to the real ones due to the Internet browser and monitor used.

4.4 Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order form.

4.5 Purchase requests from countries other than the one selected for shipment or to addresses to which the Seller cannot ship will not be accepted by the Seller.

4.6 All products have an identification tag fixed with a disposable seal. We ask you not to remove the tag and the relative seal from the purchased products, of which they form an integral part.

4.7 The Seller, in the event of exercising your right of withdrawal, has the right not to accept the return of products that do not have the relative tag or that have been altered in their essential and qualitative characteristics or that have been damaged.

5. Payments
5.1 For the payment of the price of the products and the relative shipping and delivery costs, you can follow one of the methods indicated in the order form.

8. Right of withdrawal
8.1 You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days starting from the day of receipt of the products purchased on civico41.com. However, it is not possible to change the chosen garment with another one.

8.2 To find out the specific ways in which you can withdraw from the contract, please refer to the Return Policy section. Please pay attention to what is reported in this section because the information contained therein form an integral and substantial part of these Conditions of Sale and, therefore, are deemed to be fully known and accepted by you at the time the order form is sent.

10. Governing Law
The General Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and by the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

11. Modification and update
The Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new Conditions of Sale will be effective from the date of publication on civico41.com.
